• <br /> • <br /> • <br /> 1!!!!!!!":1 <br /> 0RETT <br /> ORDINANCE NO. 1808-91 <br /> AN ORDINANCE providing for the transfer of vacation <br /> leave between employees and establishing the <br /> conditions therefor, providing that this ordinance <br /> is a pilot program with a one year sunset <br /> provision, establishing an emergency clause and <br /> fixing a time when the same shall become <br /> effective; and repealing Ordinance No. 1724-90 and <br /> all other ordinances in conflict herewith. <br /> WHEREAS, the City provides vacation leave to its employees as a <br /> vested right subject to payment upon termination; and <br /> WHEREAS, the City Council finds it appropriate and in the pubic <br /> interest to permit employees to share vacation leave in carefully <br /> defined circumstances and to transfer such leave to and for the <br /> benefit of employees who, without such transfers, would be forced <br /> to terminate their employment or go without pay in order to meet <br /> the needs of severe illness; and <br /> WHEREAS, the City Council finds that an emergency exists <br /> necessitating the immediate institution of a pilot program to <br /> prevent an unnecessary hardship on its employees; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> SECTION 1: SHARED LEAVE. <br /> A. Intent. The purpose of shared leave is to permit City <br /> employees, at no additional cost to any City fund other than <br /> administrative costs of administering the program, to come to the <br /> aid of a fellow City employee who is suffering from or has a <br /> spouse or child (under the age of eighteen (18) who resides with <br /> the employee) suffering from an extraordinary or severe illness, <br /> injury, impairment, or physical or mental conditions which has <br /> caused or is likely to cause the employee to take leave without <br /> pay or to terminate his or her employment. <br /> B. A Department Head, with the Mayor or designee's <br /> concurrence, may approve a donee employee to receive shared leave <br /> under this ordinance if: <br /> 1. The employee suffers, or has a spouse or child (under <br /> the age of eighteen (18) who resides with the employee) <br /> suffering from, an illness, injury, impairment, or <br /> physical or mental condition which is of an <br />
