. 401111111 <br /> • <br /> • <br /> • <br /> EVERETT <br /> ORDINANCE NO. 1807-91 <br /> AN ORDINANCE relating to domestic violence court <br /> orders, amending Sections 1, 2 and 4 of Ordinance <br /> No. 1234-86 (EMC 10. 22 . 010, 10. 22 . 020 and <br /> 10. 22 . 040) . <br /> WHEREAS, the State Legislature has made it a felony to commit <br /> assault or reckless endangerment that is also a violation of a <br /> domestic violence order; and <br /> WHEREAS, it is desirable for Everett laws to be in conformity <br /> with State law; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> SECTION 1: Section 1 of Ordinance No. 1234-86 (EMC 10. 22 . 010) , <br /> which read as follows: <br /> Violation of no-contact order - Pre-trial <br /> Wilful violation of a court order issued under RCW <br /> 10 . 99 . 040 (2) or RCW 10. 99 . 040 (3) is a misdemeanor. The <br /> written order releasing the person charged or arrested <br /> shall contain the court's directives and shall bear the <br /> legend: "Violation of this order is a criminal offense <br /> under Chapter 10. 99 RCW and will subject a violator to <br /> arrest. " If a no-contact order has been issued prior <br /> to charging, that order shall expire at arraignment or <br /> within seventy-two hours if charges are not filed. <br /> is hereby amended to read as follows: <br /> Violation of no-contact order - Pre-trial <br /> Wilful violation of a court order issued under RCW <br /> 10. 99 . 040 (2) or RCW 10. 99 . 040 (3) is a misdemeanor. <br /> Any assault that is a violation of an order issued <br /> under RCW 10. 99 . 040 and that does not amount to assault <br /> in the first or second degree under RCW 9A. 36. 011 or <br /> 9A. 36. 021 is a class C felony, and any conduct in <br /> violation of a protective order issued under RCW <br /> 10 . 99 . 040 that is reckless and creates a substantial <br /> risk of death or serious physical injury to another <br /> person is a class C felony.
