` S 111111 . EVE? TT ORDINANCE NO. 1796-91 AN ORDINANCE amending Section 6 of Ordinance No. 1457-88 providing for the vacation of a portion of Wilmington Avenue at Evergreen Way. NOW THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 6 of Ordinance No. 1457-88 which reads as follows: Section 6: That the City of Everett hereby retains an easement for access and to construct, reconstruct, operate, maintain, repair and replace all utilities within the vacated area. The City of Everett further retains the right to grant to public and private utilities the right to construct, reconstruct, operate, maintain, repair and replace existing or proposed utility lines including, but not limited to telephone, gas and electrical, under, over and across the property above-described is hereby amended to read as follows: Section 6: That the City of Everett hereby retains an easement for access and to construct, reconstruct, operate, maintain, repair and replace all utilities within the vacated area. The City of Everett further retains the right to grant to public and private utilities the right to construct, reconstruct, operate, maintain, repair and replace existing or proposed utility lines including, but not limited to telephone, gas and electrical, under, over and across the property described as follows: An easement lying within a portion of Block 17, Central Park, as recorded in Volume 8 of Plats on page 53, records of Snohomish County, Washington, and lying also within a portion of vacated Wilmington Avenue, as shown on said plat, being more particularly described as follows: Said easement being of variable width, lying West to the East line of Evergreen Way (Highway 99) from the following described line and 10.00 feet East of the following described line: -1- (79RP)
