EYE/7ETT <br /> ORDINANCE NO. 1784-91 <br /> AN ORDINANCE authorizing the Fire Chief to enforce provisions of <br /> the City Ftre Code (EMC Chapter 16.03) and authorizing the <br /> issuance of citations, adding three new sections to <br /> EMC Chapter 16.03. <br /> WHEREAS, the Everett City Council finds that the Fire Chief should be <br /> authorized to enforce the Fire Code with power to issue citations; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> SECTION 1 : Responsibility and Authority. <br /> A. It shall be the responsibility of the Everett Fire Chief to <br /> enforce all provisions of the City Fire Code (EMC Chapter 16.03, as now or <br /> hereafter amended) . <br /> B. The Fire Chief and his/her designee(s) shall be empowered to <br /> exercise the authority of peace officers to the extent necessary to enforce <br /> the City Fire Code, which power shall include issuance of citations. <br /> C. Persons designated by the Fire Chief to enforce the Fire Code <br /> shall bear identification reflecting the authority under which they act, <br /> which identification shall be shown to any person requesting the same. The <br /> Fire Chief is authorized to designate the Fire Marshal , Assistant Fire <br /> Marshals and Fire Inspectors to enforce the Fire Code. <br /> SECTION 2: Obstructing a Fire Inspector, Fire Marshal or Assistant Fire <br /> Marshal . <br /> A person commits the offense of Obstructing a Fire Inspector, Fire Marshal <br /> or Assistant Fire Marshal if: <br /> A. He or she intentionally uses or threatens to use force to <br /> obstruct a person he or she knows or should reasonably know is a Fire <br /> Inspector, Fire Marshal or Assistant Fire Marshal and while such Fire <br /> Inspector, Fire Marshal or Assistant Fire Marshal is performing his or her <br /> official duties; or <br /> B. He or she intentionally does any act that he or she knows or <br /> should reasonably know will interfere with or obstruct a person known to be <br />
