` ,. 4 <br /> E.. <br /> ORDINANCE NO. <br /> An Ordinance Relating to Public Works Projects and Amending <br /> Ordinance No. 2761-04 (EMC 3.80.050) and Ordinance No. 2726- <br /> 03 (EMC 3.84.030). <br /> WHEREAS, Ordinance No. 2761-04 (EMC 3.80.050) regulates authority to sign Change Orders <br /> on Public Work projects; and <br /> WHEREAS, Ordinance No. 2726-03 (EMC 3.80.050) contains the City's bid protest <br /> procedures; and <br /> WHEREAS,the City wishes to clarify Change Order authority and bid protest procedures to <br /> provide more efficient processes for Public Works projects by adopting this Ordinance and <br /> amending Ordinance No. 2761-04 and Ordinance No. 2726-03; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Section 7 of Ordinance No. 2761-04 (EMC 3.80.050(F)), which reads as follows: <br /> Public Work of At Least Five Million Dollars <br /> City Council may by resolution authorize the Mayor or the Mayor's designee to <br /> direct the contractor to perform additional work and to execute Change Orders for <br /> a Public Work project whose original contract value is at least five million dollars. <br /> is hereby amended to read as follows: <br /> Public Work of At Least Five Million Dollars <br /> City Council may by resolution authorize the Mayor or the Mayor's designee to <br /> direct the contractor to perform additional work and to execute Change Orders for <br /> a Public Work project whose original contract value is at least five million dollars. <br /> If City Council does not adopt such a resolution, then the Mayor or the Mayor's <br /> designee is authorized to direct contractors to perform additional work and to sign <br /> Change Orders on a Public Work project where the original contract value is at <br /> least five million dollars to the extent the sum of the Change Orders do not exceed <br /> an amount equal to five hundred seventy-five thousand dollars plus ten percent of <br /> 1 <br /> 2 <br />
