1 <br /> REQUEST FOR ABATEMENT OF PROPERTY,GRANTING RIGHT OF <br /> ENTRY AND WAIVER AND RELEASE <br /> I, Donald Turnbull, am the owner of the property located at 5630 Commercial Avenue, <br /> Everett,Washington. I either have lawful possession of said property or have a tenant in <br /> lawful possession whom I have and will continue to provide lawful notice of this request, <br /> right-of-entry,waiver and release and the date of actual abatement by the City of Everett <br /> (the"City"). <br /> I understand that on December 29, 2011, the City of Everett's Violations Hearing <br /> Examiner (hereinafter "VHE") ordered the abatement of violations of the Everett <br /> Municipal Code,which are listed in the VHE's Order(hereinafter"Order"),and which is <br /> incorporated by reference here. <br /> I acknowledge and understand the VHE authorized the City to enter onto the above- <br /> referenced property to effect the abatement of the violations listed in the Order without <br /> further order or direction of the VHE. <br /> I acknowledge that I have not abated the following violations listed in the Order: <br /> • There is Junk, garbage,trash, and miscellaneous debris on the property that is visible <br /> from public or private property in violation of Everett Municipal Code (the"EMC") <br /> Section 8.20.020.A. <br /> • There is grass weeds and blackberry vines that have- become overgrown and are <br /> visible from public or private property in violation of EMC 8.20.020.E. <br /> • There is household garbage accumulating on the exterior of the property in violation <br /> of Section 308.1 of the International Property Maintenance Code (the "IPMC") as <br /> adopted by the City. <br /> • The containers for rubbish and garbage are not covered,which is a violation of IPMC <br /> 308.2.1. <br /> • There is garbage on the exterior of the property that was not disposed of in a clean <br /> and sanitary manner by placing it in an approved disposal facility or container,which <br /> is a violation of IPMC 308.3. <br /> I allege that I have abated the following violations listed in the Order: <br /> None. <br /> I agree to allow and hereby request the City use the services of one or more contractors <br /> selected solely by the City to abate ALL the above-referenced unabated violations at <br /> 5630 Commercial Avenue, Everett, Washington.
