In terms of attorney caseload management,what is the city's method of counting probation <br /> violations and other post-resolution hearings? <br /> The number of probation cases in the preceding:table:is artificially high due to the way our <br /> municipal court handles probation reviews. Instead of holding review hearings only when the court <br /> has`been notified of a probationer's failure to comply by the probation department or a prosecutor's <br /> motion,the court holds regular review hearings at set intervals regardless of compliance status. A <br /> public defender is present at every review calendar. When an indigent probationer has failed to <br /> comply,the public defender will typically ask for a continuance to another review date and in the <br /> interim work with the probationer to get them on track and compliant and represent them at the <br /> continued review hearing. The majority of review hearings involve no more than the probation <br /> officer informing the court that there have been no violations by that particular defendant. A fully <br /> compliant defendant will have several review hearings in the course of their probation and a public <br /> defender is present for each hearing. The number of hearings that involve alleged noncompliance <br /> has not been separately tracked but is much smaller than the total shown in the table. <br /> 4.
