28 <br /> AMENDMENT NO.1 TO PROFESSIONAL SERVICES AGREEMENT BETWEEN <br /> THE CITY OF EVERETT <br /> AND <br /> AMEC Earth and Environmental <br /> The City and AMEC Earth and Environmental whose address is 11810 <br /> North Creek Parkway ,North, Bothell,Washington 98011 agree to amend and modify their <br /> professional services agreement dated February 22,2010 (the"Agreement") as follows: <br /> WHEREAS, AMEC Earth and Environmental and the City entered into an agreement to provide <br /> Environment Professional Services on a Task Order basis to the City of Everett. Work could <br /> include biological assessments/evaluations;habitat management plans;biological surveys in <br /> uplands, streams and wetlands; stream and wetland restoration design and reporting; and <br /> artificial wetlands;water quality evaluations,wetland identification and delineations; <br /> environmental permitting support; emergency action plans; cultural resource assessments; and <br /> miscellaneous related environmental and natural resources services as requested. <br /> WHEREAS, AMEC Earth and Environmental and the City have entered into a professional <br /> Services agreement to engage service provider to Paul Crane for the City of Everett in a <br /> Professional Services Agreement made and entered into on the 22nd day of February, 2010 to <br /> December 31, 2012 <br /> WHEREAS, AMEC Earth and Environmental and the City will need to amend the agreement as <br /> the total amount stated in the agreement is insufficient for the remainder of projects that <br /> environmental work will be needed, an additional $110,000 will be needed to complete <br /> WHEREAS, the City of Everett desires continued services and assistance from Service provider <br /> AMEC Earth and Environmental <br /> NOW THEREFORE, the City of Everett and AMEC Earth and Environmental agree to amend <br /> and modify the previously amended Agreement as follows: <br /> 1. The following work is added to the Scope of Work described in Exhibit A of the <br /> Agreement: <br /> 2. Paragraph 4(D) is modified to read as follows: <br /> Total compensation, including all services and expenses, shall not exceed a <br /> maximum of One Hundred and Ten Thousand Dollars ($110,000). <br /> 3. No other changes to the professional services agreement will be needed. <br /> 4. The effective date of this Amendment is <br /> 5.
