5 <br /> When a structure or equipment is found by the code official to be unsafe, or when a <br /> structure is found unfit for human occupancy, or is found unlawful, such structure <br /> shall be condemned pursuant to the provisions of this code. <br /> 4. IPMC 108.1.3 Structure unfit for human occupancy, which reads; <br /> A structure is unfit for human occupancy whenever the code official finds that such <br /> structure is unsafe, unlawful or, because of the degree to which the structure is in <br /> disrepair or lacks maintenance, is insanitary, vermin or rat infested, contains filth <br /> and contamination, or lacks ventilation, illumination, sanitary or heating facilities or <br /> other essential equipment required by this code, or because the location of the <br /> structure constitutes a hazard to the occupants of the structure or to the public. <br /> Conclusions of Law Based on Above Findings: <br /> 1. By failing to maintain the plumbing systems, electrical systems and mechanical <br /> systems of the structure rendering it unfit for human habitation, the Respondent <br /> violated IPMC 108.1 and IPMC 108.1.3. <br /> 2. By allowing discarded furniture and bagged trash to accumulate and remain in the <br /> yards of the property, the Respondent violated EMC 8.20.020(A)(C). These <br /> violations are public nuisances. <br /> 3. By allowing unlicensed and therefore inoperable vehicles to be situated on the <br /> property, the Respondent violated EMC 8.22.030(A). This violation is a public <br /> nuisance. <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of Law as stated above, it is hereby <br /> determined that the Respondent is in default and is in violation of EMC 8.20.020(A)(C), <br /> EMC 8.22.030(A), IPMC 108.1.3 and IPMC 108.1 and is hereby ordered to: <br /> 1. The Respondent shall abate all violations of EMC 8.20.020(A)(C), EMC <br /> 8.22.030(A), IPMC 108.1.3 and IPMC 108.1 on property located at 1115 North <br /> Broadway, Everett, Washington. <br /> 2. All abatement of the violations on said property shall be completed by December <br /> 31, 2013. The cleanup and abatement shall include: <br /> a. The Respondent shall vacate all buildings and commercial operations by 12:00 <br /> noon on December 18, 2013. Any occupancy of the structures on site without <br /> permission of the City, will subject the persons responsible to possible criminal <br /> prosecution. <br /> b. The Respondent shall secure all windows and doors within 48 hours of the <br /> vacation (December 18, 2013 at 5:00 pm) of the structures in compliance with <br /> Appendix A of the International Property Maintenance Code. <br />
