The regulatory agencies have determined that the Project <br /> requires mitigation. However,on-site mitigation for the Project is not possible because no mitigation area is <br /> available to the District. <br /> The City's advanced mitigation site is located east of the Oxidation Pond on Smith Island.This Agreement <br /> provides for the purchase by the District of up to two acres of mitigation for Project use. The District will <br /> pay$120,000 an acre for the mitigation. . <br /> RECOMMENDATION (Exact action requested of Council): <br /> Authorize the Mayor to sign the Interlocal Agreement with Diking District No. 5 for the purchase of up to <br /> two acres of mitigation. <br /> 133 <br />
