RDC is the tenant of the Property pursuant to the RDC Lease, <br /> which lease is defined in Section 7 below, and is executing this Agreement on behalf of itself <br /> and its successors and assigns to the tenant's interest under the RDC Lease. <br /> In consideration of mutual benefits to be derived and in consideration of and subject to <br /> the performance of the covenants, terms and conditions hereinafter set forth, Grantor hereby <br /> conveys and warrants to the City, subject to the terms and conditions contained herein, a non- <br /> exclusive perpetual thirty-foot (30') wide easement in gross across, along, in, upon and under <br /> the portion of the Property that is described on Exhibit B attached hereto (such portion of the <br /> Property the "Waterline Easement"), the approximate location of which is depicted on <br /> Exhibit C attached hereto. The City may use the Waterline Easement for the purposes of <br /> installing, constructing, reconstructing, operating, maintaining and repairing an underground <br /> water transmission pipeline, including any appurtenances thereto.
