Selection of the GC/CM was partially based on the quality of staff proposed, and a lower point total may have resulted by not including those staff in the Proposal. No Waiver: No payment, whether monthly or final, to the GC/CM for any Project work shall constitute a waiver or release by the Owner of any claims, rights, or remedies it may have against the GC/CM under this Contract or by law, nor shall such payment constitute a waiver, remission, or discharge by the Owner of any failure or fault of the GC/CM to satisfactorily perform the Project work as required under this Contract. Failure by Owner to require or enforce any provision of this Contract shall not constitute a waiver or release by Owner of any rights or remedies, or to require contractual performance by GC/CM. GC/CM agrees to perform all services under this contract in accordance with all applicable federal, state, and local laws and regulations.
