This construction contract was awarded by Council in January 2012 for 2,414,286.60. Construction was suspended in September 2012 due to a number of issues, including permitting changes and alterations in the river conditions. The attached agreement delivers.a final $300,000 contractor payment,terminates the construction contract, and resolves all pending contractor claims. It is the intent of the Utilities Division to make adjustments to the project,and rebid the project for construction in Summer 2013. RECOMMENDATION(Exact action requested of Council): Authorize the Mayor to sign the attached Project Close Out and Settlement Agreement for Transmission Line Number 5 Replacement at Pilchuck River in the amount of$300,000. 19
