EVERETT CITY COUNCIL AGENDA ITEM COVER SHEET i
PROJECT TITLE:
An Ordinance relating to Briefing COUNCIL BILL# ('E` 331 —O
Regulation of the Chaplain Proposed Action Originating Department Legal
Tract and Watershed, Consent Contact Person Hil Kaman
Repealing Ordinances in Action Phone Number 425-257-8762
accordance with Section 30 of 02/06/13 First Reading FOR AGENDA OF 02/06/13,
this Ordinance. 02/13/13 Second Reading 02/13/13,
02/20/13 Third Reading 02/20/13
Public Hearing
Initialed by:
Department Head
CAA
Council President a
Location Preceding Action Attachments Department(s)Approval
Chaplain Tract Map of Chaplain Tract ■Legal
■Public
Works
Amount Budgeted
Expenditure Required
Budget Remaining
Additional Required
DETAILED SUMMARY STATEMENT:
The City owns and manages lands commonly known as the Chaplain Tract, which contain vital natural
resources and infrastructure that make up the City's domestic water supply system. Traditionally, human
activity has been permitted in some areas of the Chaplain Tract, while other areas have been closed entirely,
particularly within the Chaplain Reservoir Watershed Boundary, because human activity in these areas could
jeopardize water quality. Currently, human activity within the Chaplain Tract is regulated by several Everett
Municipal Code chapters, which have potentially conflicting language. The proposed ordinance resolves this
by enacting.a single chapter to: 1) Clearly identify those areas of the Chaplain Tract where human activity is
permitted (to be called Chaplain Tract North) and those areas where it is not (to be called Chaplain Tract
South;) 2) Clearly regulate human activity in those areas where it is permitted by setting out which activities
are allowed and which activities are not; and 3) Define violations as punishable by either criminal or civil
penalties based on their relative severity and risk to water quality and public safety.
RECOMMENDATION:
Adopt an Ordinance relating to Regulation of the Chaplain Tract and Watershed,Repealing Ordinances in
accordance with Section 30 of this Ordinance.
1
