ARTICLE 15 - SENIORITY <br /> Section 1: <br /> Employees shall complete the applicable probationary period before they become regular <br /> employees entitling them to seniority rights. <br /> Section 2: <br /> Seniority shall be computed using the adjusted employment date, subject to the applicable <br /> probationary period. <br /> Section 3: <br /> Classification seniority shall be recognized as follows: <br /> A. The supervisor shall recognize seniority in assignments of duties within a job class on a <br /> job site wherein the assignments change on a periodic basis; provided that, this provision does <br /> not apply to regular vacancies. <br /> B. Those employees having greater classification seniority shall be given preference in the <br /> selection of call-outs and assignment of overtime. <br /> Lists for call-outs and assignment of overtime shall be established at least annually in each <br /> department. Lists shall be established for each shift by classification and type of work <br /> comprised of all employees qualified to undertake the assignment. Placement on the list shall <br /> be by employee choice in seniority order, or if by management agreement, following a Union <br /> conducted majority vote of the affected individuals, a rotational system may be established. <br /> Any employee refusing overtime or call-outs three times during the life of the list shall be moved <br /> to the bottom of the list or to the lowest position that will not displace a more senior employee. <br /> An employee may not receive more than one refusal for a given day of assigned work. <br /> C. Projects or assignments with defined responsibilities which involve overtime shall be <br /> exempt from this provision when continuity provides specialized knowledge or training that is <br /> needed for the efficient performance of the work. <br /> Section 4: <br /> Seniority shall terminate by the employee being discharged from service or by the employee <br /> voluntarily leaving the service of the City. Any employees laid off who are subsequently <br /> recalled shall be credited back with the seniority they had at the time they were laid off. <br /> Page 33 <br />
