CITY <br /> TEMPORARY CONSTRUCTION EASEMENT <br /> This instrument ("Agreement") is made the )4' day of apY1 I , 2017, <br /> between the CITY OF EVERETT, a municipal corporation, under the laws of the State of <br /> Washington (hereinafter referred to as "Grantor") and Comcast of Washington IV, Inc., <br /> their employees, agents, contractors, or invitees, (hereinafter referred to as "Grantee") for <br /> and in consideration of mutual benefits and other good and valuable consideration, <br /> Grantor does hereby convey and grant to Grantee, the temporary right, privilege and <br /> easement over, under, upon and across the hereinafter described lands for the purpose of <br /> • <br /> providing access and grading/excavation activities related to the installation of <br /> communications/data facilities by Grantee. <br /> The temporary rights herein granted shall terminate upon completion of construction <br /> activities or on December 31, 2017, whichever occurs first. <br /> The temporary construction easement herein granted is located upon lands within a utility <br /> easement being situated in Snohomish County, State of Washington, as generally <br /> depicted on Exhibit A attached hereto and included herein by reference to this Agreement <br /> (the"Easement Area"). <br /> This easement is granted subject to the general terms and conditions as follows: <br /> 1. Use of Grantor's Property by Grantor: <br /> Grantee's rights herein shall at all times be subordinate to the rights of the Grantor. <br /> 2. Grantee's Use and Activities: <br /> Grantee's use of the easement area shall in conformance with the approved plans and <br /> conditions of Public Works Permit # PW . Grantee shall exercise <br /> its rights under the Public Works Permit and this Agreement so as to minimize and <br /> avoid, insofar as possible, interference with any use by Grantor of Grantor's property <br /> and shall at all times conduct its activities on the easement area so as not to interfere <br /> with, obstruct or endanger the Grantor's operations, facilities or other utilities. <br />
