miliWAI <br /> ORDINANCE NO. 3549-17 <br /> An Ordinance Relating to Water, Sewer Service, and Surface <br /> Water Management Rates, repealing Sections 17 and 25 of <br /> Ordinance 3529-17. <br /> WHEREAS, <br /> A. Ordinance 3529-17 concerned water, sewer service, and surface water <br /> management rates. <br /> B. Section 17 of Ordinance 3529-17 states in part that that "Ordinance No. 3417-14 <br /> (EMC 14.14.020) and 3299-12 (EMC 14.16.710, 711, 712 and 713) shall be repealed upon the <br /> effective date of this ordinance." However, the ordinance references and Everett Municipal <br /> Code references in Section 17 are inconsistent, causing questions about what, if anything, <br /> Section 17 repealed. However, no repeal of any past ordinances was necessary for Ordinance <br /> 3529-17. Because of this, Section 17 is superfluous and confusing and should be repealed. <br /> C. Section 25 of Ordinance 3529-17 contains confusing language regarding <br /> codification. This language is unnecessary. Accordingly, the City Council should repeal <br /> Section 25. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Section 17 of Ordinance 3529-17, which reads as follows: <br /> Ordinance No. 3417-14 (EMC 14.14.020) and 3299-12 (EMC 14.16.710, 711, <br /> 712 and 713) shall be repealed upon the effective date of this ordinance; provided <br /> that findings relating to sewer system costs under Ordinances 1976-93, 237-73, <br /> 627-79, 1264-86, 1437-88, 1538-88, 1538-88, 1834-91, 1871-92, 1933-93, 2142- <br /> 96, 2189-96, 2366-99, 3096-08, 3156-09, 3299-12 and 3417-14 are incorporated <br /> herein for background purposes <br /> is hereby repealed. <br /> 1 <br />
