Ordinance No. 791 f;–()r, <br />An Ordinance relating to Code Enforcement Procedures <br />Amending Section 1 of Ordinance No. 1383-87, as amended (EMC 1.20.010); <br />Section 2 of Ordinance No. 1383-87, as amended (EMC 1.20.020); Section 4 of <br />Ordinance No. 1383-87, as amended (EMC 1.20.040); Section 6 of Ordinance No. 2221- <br />97, as amended (EMC 1.20.060); Section 6 of Ordinance No. 2335-98 (EMC 1.20.070); <br />Section 7 of Ordinance No. 2335-98 (EMC 1.20.080); and Section 8 of Ordinance No. <br />2335-98 (EMC 1.20.090); and adding a section. <br />Whereas, the Everett City Council has been apprised of situations occurring <br />under the current code enforcement procedures that defeat or unreasonably delay <br />enforcement action, to -wit: subjects of violation citations moving nuisance conditions to <br />adjoining private or public property or taking corrective action but immediately engaging <br />in the same nuisance conduct again; and <br />Whereas, the Everett City Council deems it necessary and appropriate for code <br />violators to be subject to orders of the violations hearing examiner, whether or not <br />corrective action was taken before hearing, for deterrence of future similar conduct; and <br />Whereas, the Everett City Council deems it necessary and appropriate for the <br />enforcement procedures codified in Chapter 1.20 of the Everett Municipal Code to apply <br />to violations of the City of Everett Building Code; and <br />Whereas, the Everett City Council deems it necessary and appropriate for repeat <br />violators to be subject to an additional fine, over and above the fines for each violation; <br />NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br />Section 1: Section 1 of Ordinance No. 1383-87, as amended by Section 1 of Ordinance <br />No. 1780-91, Section 1 of Ordinance No. 2221-97 and Section 1 of Ordinance No. 2335- <br />98 (EMC 1.20.010), which reads as follows: <br />Violation citations—Issuance—Default. <br />A. A code compliance officer, the director of code compliance or his/her designee <br />(hereinafter referred to as "a code compliance officer") is authorized to issue and serve a <br />violation citation upon reasonable belief that the following has occurred: <br />1. A violation of one or more of the provisions of any ordinance set forth in <br />Section 1.20.020; or <br />1 <br />
