it is agreed that the work covered by this contract shall be completed in <br /> all respects within 0.:70 calendar days from the date of Notice to <br /> Proceed. It is further agreed that the City will suffer damage and be put <br /> to additional expense in the event that the Contractor shall not have the <br /> work completed in all respects and ready for use prior to the completion <br /> date stated. Said damages are liquidated in the amount of $500 per day for <br /> each consecutive calendar day of delay in reaching substantial completion <br /> after the scheduled date for substantial completion. It is hereby agreed <br /> that damages for Contractor delay shall be deducted from payment due the <br /> Contractor. <br /> It is further agreed that the amount of this contract is <br /> $ 1,2ci SCOW and is based on proposal submitted by the Contractor <br /> dated c-1-0 2- Lit# mcv) . The Contractor shall be paid such amount (less <br /> any damage offsets pursuant to the preceding paragraph, but including any <br /> additional charges for change orders consented to by the City consistent <br /> with the terms of the Construction Documents, and less a deduction of five <br /> percent (5%) which shall be withheld in compliance with Chapter 60.28 RCW) <br /> only upon completion of the Facility to the satisfaction of the City, as <br /> prescribed by the Construction Documents. Said payment shall be made not by <br /> the City but will be made instead by the assignee of the Lease, the Facility <br /> and the Ground Lease, in accordance with the Lease-Financing Documents. The <br /> City is under no obligation to advance sums towards construction of the <br /> Facility, nor is the City liable for payment of costs of construction. The <br /> City will pay lease rental to the lessor under the Lease or its assignee of <br /> • the Contractor's interests in the Lease, Facility and Ground Lease. <br /> The Contractor is responsible for obtaining interim construction financing <br /> for the Facility. Contractor has obtained a commitment for such interim <br /> financing from C M C3A N4kf., , and such <br /> financing entity has, prior to issuing such financing commitment, received <br /> copies of the Lease-Financing Documents from Contractor. <br /> The Contractor agrees to comply with all state and federal laws relating to <br /> the employment of labor and wage rates to be paid. The Contractor agrees to <br /> furnish insurance of the types and the amounts set forth in the Contract <br /> Documents. <br /> The Contractor agrees that he shall actively solicit the employment of <br /> minority group members. Contractor further agrees that he shall actively <br /> solicit bids for the subcontracting of goods or services from qualified <br /> minority businesses. Contractor shall furnish evidence of his compliance <br /> with these requirements of minority employment and solicitation. Contractor <br /> further agrees to consider the grant of subcontracts to said minority <br /> bidders on the basis of substantially equal proposals in the light most <br /> favorable to said minority businesses. The Contractor shall be required to <br /> submit evidence of compliance with this section. As used in this section, <br /> the term "minority business" means a business at least fifty-one percent of <br /> which is owned by minority group members. Minority group members include, <br /> but are not limited to, Blacks, women, Native Americans, and Orientals. <br /> 2 <br />
