CITY OF EVERETT SPECIAL PROVISIONS <br /> Day. When any of these holidays fall on a Sunday, the following Monday shall be <br /> counted a nonworking day. When the holiday falls on a Saturday, the preceding <br /> Friday shall be counted a nonworking day. The days between December 25 and <br /> January 1 will be classified as nonworking days. <br /> An unworkable day is defined as a half or whole day the Engineer declares to be <br /> unworkable because of weather or conditions caused by the weather that <br /> prevents satisfactory and timely performance of the Work shown on the critical <br /> path of the Contractor's approved progress schedule. Other conditions beyond <br /> the control of the Contractor may qualify for an extension of time in accordance <br /> with Section 1-08.8. <br /> Contract Time shall begin on the effective date of the Notice to Proceed. The <br /> Contract Documents may specify another starting date for Contract Time, in <br /> which case, Contract Time will begin on the starting date the Contract <br /> Documents specify. <br /> Each working day shall be charged to the Contract as it occurs, beginning on the <br /> effective date of the Notice to Proceed, unless otherwise provided in the Contract <br /> Documents, until the Contract Work is physically complete. Each week the <br /> Engineer will provide the Contractor a statement that shows the number of <br /> working days: (1) charged to the Contract the week before; (2) specified for the <br /> physical completion of the Contract; and (3) remaining for the physical <br /> completion of the Contract. The statement will also show the nonworking days <br /> and partial or whole day the Engineer declares as unworkable. Within 14 <br /> calendar days after the date of each statement, the Contractor shall file a written <br /> protest of any alleged discrepancies in it. To be considered by the Engineer, the <br /> protest shall be in sufficient detail to enable the Engineer to ascertain the basis <br /> and amount of time disputed. By not filing such detailed protest in that period, <br /> the Contractor shall be deemed as having accepted the statement as correct. If <br /> the Contractor elects to work ten hours a day and four days a week (a 4-10 <br /> schedule) and the fifth day of the week in which a 4-10 shift is worked would <br /> ordinarily be charged as a working day then the fifth day of that week will be <br /> charged as a working day whether or not the Contractor works on that day. <br /> The Engineer will give the Contractor written notice of the Physical Completion <br /> Date for all Work the Contract requires. That date shall constitute the Physical <br /> Completion Date of the Contract, but shall not imply the City's acceptance of the <br /> Work or the Contract. <br /> The Engineer will give the Contractor written notice of the Completion Date of the <br /> Contract after all the Contractor's obligations under the Contract have been <br /> performed by the Contractor. The following events must occur before the <br /> Completion Date can be established: <br /> 1. The physical Work on the project must be complete; and <br /> 2. The Contractor shall furnish all documentation required by the Contract <br /> and required by law, to allow the City to process final acceptance of the <br /> Contract. <br /> The following documents must be received by the Engineer prior to establishing a <br /> Completion Date: <br /> a. Certified payrolls. <br /> b. Material Acceptance Certification Documents. <br /> c. Annual Report of Amounts Paid as MBE/WBE Participants. <br /> d.
