CITY OF EVERETT SPECIAL PROVISIONS <br /> shall maintain the Project site and perform the Work in a manner that meets the <br /> City's responsibility under statutory and common law for the provision of a safe <br /> place to work. <br /> 1-05.18(3)F Threats, Intimidation and Harassment Forbidden <br /> Contractor shall not allow its employees, its Subcontractors, its Subcontractors' <br /> employees, or any other agents to threaten bodily injury or property damage, to <br /> intimidate or attempt to intimidate any person, or to assault or physically harass <br /> any person. Forbidden conduct includes, but is not limited to, threatening, <br /> appearing, or actually doing any of the following: pushing, shoving, striking, <br /> physically blocking a person or a person's vehicle, vandalism, malicious mischief, <br /> or any other act that a reasonable person would understand be intended to <br /> intimidate, cause personal injury, or cause property damage. Contractor shall <br /> remove from the job site any person reasonably under its control or direction who <br /> the Contractor or City reasonably believes violated this section. The lack of a <br /> request from the City or City's Representative to the Contractor to remove <br /> someone from the job site does not relieve the Contractor from its obligation to <br /> remove someone. <br /> 1-05.18(3)G Weapons Forbidden <br /> Contractor shall not allow its employees, its Subcontractors, its Subcontractors' <br /> employees, or any other agents or representatives to carry or possess, openly or <br /> concealed, explosives or weapons on the job site, except: (a) such explosives <br /> are as reasonably required for performance of the Work, such as those <br /> necessary for blasting or demolition work called for by the Contract Documents <br /> or (b) commissioned law enforcement officers or security personnel under <br /> authority of their commission. A weapon is any object, instrument or chemical <br /> that is (1) designed in such a manner to inflict harm or injury to another person; <br /> or (2) any item used in a manner threatening harm or injury to another person. <br /> Weapons include, but are not limited to, firearms, dangerous knives, dangerous <br /> chemicals, tear gas, martial arts weapons, blackjacks or other weapons. Further, <br /> weapons should include those described in EMC Chapter 10.78. Possession of <br /> mace, pepper spray or the like for defensive purposes is not a violation of this <br /> policy. Contractor shall remove from the job site any person reasonably under its <br /> control or direction who the Contractor or City reasonably believes violated this <br /> section. The lack of a request from the City or City's Representative to the <br /> Contractor to remove someone from the job site does not relieve the Contractor <br /> from its obligation to remove someone. <br /> 1-05.18(3)H Safety Standards <br /> The Contractor shall comply with Section 107 of the Contract Work Hours and <br /> Safety Standards Act (40 U.S.C. 327-330) as supplemented by Department of <br /> Labor Regulations (29 CFR, Part 5). Under this Section, the Contractor shall not <br /> require any laborer or mechanic to work in surroundings or under working <br /> conditions that are unsanitary, hazardous, or dangerous to its health and safety <br /> as determined under construction, safety, and health standards promulgated by <br /> the Secretary of Labor. These requirements do not apply to the purchase of <br /> supplies or materials or articles ordinarily available on the open market, or <br /> contracts for transportation or transmission of intelligence. <br /> 1-05.18(3)1 Public Safety and Convenience <br /> The Contractor shall conduct its work so as to ensure the least possible <br /> obstruction to traffic and inconvenience to the general public, business, <br /> organizations and residents in the vicinity of the Work and to reasonably protect <br /> Water Main Replacement R Division 1 —GENERAL REQUIREMENTS March 1, 2017 <br /> WO No—UP3646 SP-64 <br />
