CITY OF EVERETT SPECIAL PROVISIONS <br /> persons and property. No roads or street shall be closed to the public except <br /> with the permission of the City's Representative and the proper governmental <br /> authority. Fire hydrants on or adjacent to the Work shall be accessible to <br /> firefighting equipment. Temporary provisions shall be made by the Contractor for <br /> the use of sidewalks, private and public driveways and proper functioning of <br /> gutters, sewer inlets, drainage ditches and culverts, irrigation ditches and natural <br /> water courses. <br /> 1-05.19 City-Contractor Coordination <br /> (******) <br /> 1-05.19(1) Suggestions to Contractor <br /> Nothing in these Contract Documents requires the City's Representative to provide the <br /> Contractor with direction or advice on how to do the Work, construction practices, or <br /> means and methods. If the City's Representative approves, suggests or recommends <br /> any construction practice, means, method or manner for doing the Work or producing <br /> materials, the approval or recommendation shall not: (A) guarantee that following the <br /> method or manner will result in compliance with the Contract Documents; (B) relieve <br /> the Contractor of any risks or obligations under the Contract Documents; or (C) create <br /> liability by the City to the Contractor. <br /> Suggestions as to the plans or methods of accomplishing the Work or Contract <br /> requirements by the City or the City's Representative to the Contractor but not <br /> specified or required, if adopted or followed by the Contractor in whole or in part, shall <br /> be used at the risk and responsibility of the Contractor. The City and the City's <br /> Representative assume no responsibility therefore and in no way will be held liable for <br /> any defects in the Work which may result from or be caused by use of such plan or <br /> method of Work. <br /> 1-05.19(2) Meetings with City <br /> The Contractor shall have its duly authorized representative attend periodic <br /> informational meetings with the City's Representative and City staff, as reasonably <br /> required by the City. <br /> Contractor, City, and City's Representative shall meet as often as determined by the <br /> City's Representative, but no less often than once each month. The purpose of the <br /> meeting is to review Project status in relation to the construction schedule; review <br /> value of Work completed during the previous month; and, if applicable, review <br /> Contractor's plans to return Project status to that required by the schedule. If <br /> requested by the City or City's Representative, the Contractor shall submit a written <br /> progress report within five (5) days following this meeting, comprising: <br /> The current construction schedule indicating percent complete, actual completion or <br /> start dates since the previous review, the estimated remaining duration for each activity <br /> in progress, Schedule of Values update, and narrative summary. <br /> Reasons any activities are behind schedule and the corrective steps being taken. <br /> 1-05.19(3) Cooperation with Others <br /> The Contractor agrees to permit entry to the work site by the City, its employees or <br /> other contractors performing Work on behalf of the City. The Contractor shall afford to <br /> the City, other contractors and their employees, reasonable facilities and cooperation <br /> and arrange its work and dispose of its materials in such a manner as to not interfere <br /> with the activities of the City or of others upon the site of Work. The Contractor shall <br /> promptly make good Contractor-caused injury or damage to persons or property that <br /> may be sustained by other contractors or employees of the City.
