CITY OF EVERETT SPECIAL PROVISIONS <br /> 1-07.18(5)H Builder's Risk <br /> If the Project includes construction of a structure, the Contractor shall maintain <br /> property insurance under an "All Risk Builder's Risk" form in an amount equal to <br /> the value of the structure in a form acceptable to the City. The structure shall <br /> have All Risk Builder's Risk Insurance inclusive of earthquake and flood subject <br /> to customary industry deductibles. <br /> 1-07.20 Patented Devices, Materials, and Processes <br /> Delete the first paragraph of 1-07.20 and substitute the following: <br /> The Contractor shall assume all costs arising from the use of patented devices, <br /> materials, or processes used on or incorporated in the Work, and agrees to indemnify, <br /> defend, and save harmless the City, and its officers, employees and agents from all <br /> actions of any nature for, or on account of the use of any patented devices, materials, <br /> or processes. <br /> 1-07.23 Public Convenience and Safety <br /> Delete the last sentence of the first paragraph of 1-07.23 and substitute the following: <br /> Nothing contained in this Contract is intended to create any third-party beneficiary <br /> rights in favor of the public or any individual utilizing the facilities being constructed or <br /> improved under this Contract. <br /> 1-07.23(1) Construction Under Traffic <br /> Supplement 1-07.23(1) by adding the following after item 5 in the second paragraph: <br /> Maintain a minimum of one lane remaining open to traffic at all times. <br /> If Engineer determines the permitted closure hours adversely affect traffic, the <br /> Engineer may adjust the hours accordingly. The Engineer will notify the <br /> Contractor in writing of any change in the closure hours. <br /> No lane closures will be allowed on a holiday or holiday weekend, or after 12:00 <br /> p.m. on a day prior to a holiday or holiday weekend. A holiday weekend is <br /> defined as having a holiday fall on Friday, Saturday, Sunday or Monday. <br /> Provide a uniformed off-duty Police Officer to control traffic in critical situations as <br /> determined by the Engineer. The uniformed officer will be paid under contract <br /> item "Traffic Control Labor -Off Duty Police Officer." If "Traffic Control Labor -Off <br /> Duty Police Officer" item is not in the bid proposal, then payment will be made via <br /> change order. <br /> Notify the local Fire, Police and Engineering Departments before the beginning of <br /> each phase of construction so that these agencies may re-route their emergency <br /> vehicles around the construction zone. The non-emergency phone number for <br /> Everett Police is 258-2484, for Fire Dispatch is 257-8757, and for Public Works <br /> Engineering is 257-8800. <br /> Notify City of Everett Transit at 425-257-8984 and Community Transit at 425-348- <br /> 7100 of all street closures or delays at least 24 hours in advance to enable <br /> rerouting of buses. <br /> Notify the property owners at least 72 hours in advance to enable them to <br /> remove vehicles parked in the vicinity of Work. Towing vehicles shall be the <br /> responsibility of the Contractor and no additional payment will be made. <br /> Further supplement 1-07.23(1) by adding the following: <br /> 1-07.23(1)A General Requirements Traffic <br /> The following general requirements apply to all Work on the Project: <br /> Water Main Replacement R Division 1 —GENERAL REQUIREMENTS March 1, 2017 <br /> WO No—UP3646 SP—81 <br />
