I <br /> I1 carrying out the work. Exceptions to this are noted in the Bid Documents or will <br /> 2 be brought to the Contractor's attention by a duly issued Addendum. <br /> I 3 <br /> 4 Whenever any of the work is accomplished on or through property other than <br /> 5 public Right of Way, the Contractor shall meet and fulfill all covenants and <br /> I 6 stipulations of any easement agreement obtained by the Contracting Agency <br /> 7 from the owner of the private property. Copies of the easement agreements <br /> 8 may be included in the Contract Provisions or made available to the Contractor <br /> I 9 as soon as practical after they have been obtained by the Engineer. <br /> 10 <br /> 11 Whenever easements or rights of entry have not been acquired prior to <br /> 12 advertising, these areas are so noted in the Plans. The Contractor shall not <br /> I 13 proceed with any portion of the work in areas where right of way, easements or <br /> 14 rights of entry have not been acquired until the Engineer certifies to the <br /> 15 Contractor that the right of way or easement is available or that the right of entry <br /> I 16 has been received. If the Contractor is delayed due to acts of omission on the <br /> 17 part of the Contracting Agency in obtaining easements, rights of entry or right of <br /> 18 way, the Contractor will be entitled to an extension of time. The Contractor <br /> I 19 agrees that such delay shall not be a breach of contract. <br /> 20 <br /> 21 Each property owner shall be given 48 hours notice prior to entry by the <br /> I 22 Contractor. This includes entry onto easements and private property where <br /> 23 private improvements must be adjusted. <br /> 24 <br /> 25 The Contractor shall be responsible for providing, without expense or liability to <br /> I26 the Contracting Agency, any additional land and access thereto that the <br /> 27 Contractor may desire for temporary construction facilities, storage of materials, <br /> 28 or other Contractor needs. However, before using any private property, whether <br /> I29 adjoining the work or not, the Contractor shall file with the Engineer a written <br /> 30 permission of the private property owner, and, upon vacating the premises, a <br /> 31 written release from the property owner of each property disturbed or otherwise <br /> I 32 interfered with by reasons of construction pursued under this contract. The <br /> 33 statement shall be signed by the private property owner, or proper authority <br /> 34 acting for the owner of the private property affected, stating that permission has <br /> I 35 been granted to use the property and all necessary permits have been obtained <br /> 36 or, in the case of a release, that the restoration of the property has been <br /> 37 satisfactorily accomplished. The statement shall include the parcel number, <br /> I <br /> 38 <br /> 39 address, and date of signature.
