I 3 4 Whenever any of the work is accomplished on or through property other than 5 public Right of Way, the Contractor shall meet and fulfill all covenants and I 6 stipulations of any easement agreement obtained by the Contracting Agency 7 from the owner of the private property. Copies of the easement agreements 8 may be included in the Contract Provisions or made available to the Contractor I 9 as soon as practical after they have been obtained by the Engineer. 10 11 Whenever easements or rights of entry have not been acquired prior to 12 advertising, these areas are so noted in the Plans. The Contractor shall not I 13 proceed with any portion of the work in areas where right of way, easements or 14 rights of entry have not been acquired until the Engineer certifies to the 15 Contractor that the right of way or easement is available or that the right of entry I 16 has been received. If the Contractor is delayed due to acts of omission on the 17 part of the Contracting Agency in obtaining easements, rights of entry or right of 18 way, the Contractor will be entitled to an extension of time. The Contractor I 19 agrees that such delay shall not be a breach of contract. 20 21 Each property owner shall be given 48 hours notice prior to entry by the I 22 Contractor. This includes entry onto easements and private property where 23 private improvements must be adjusted. 24 25 The Contractor shall be responsible for providing, without expense or liability to I26 the Contracting Agency, any additional land and access thereto that the 27 Contractor may desire for temporary construction facilities, storage of materials, 28 or other Contractor needs. However, before using any private property, whether I29 adjoining the work or not, the Contractor shall file with the Engineer a written 30 permission of the private property owner, and, upon vacating the premises, a 31 written release from the property owner of each property disturbed or otherwise I 32 interfered with by reasons of construction pursued under this contract. The 33 statement shall be signed by the private property owner, or proper authority 34 acting for the owner of the private property affected, stating that permission has I 35 been granted to use the property and all necessary permits have been obtained 36 or, in the case of a release, that the restoration of the property has been 37 satisfactorily accomplished. The statement shall include the parcel number, I 38 39 address, and date of signature.
