ORDINANCE No. 3551-17 AN ORDINANCE Relating to Permitting Prostitution, Amending Section 2 of Ordinance No. 1567-89, as Amended (Chapter 10.24.130 EMC). Whereas, the Everett Municipal Court has recently ruled that the City ordinance prohibiting the crime Permitting Prostitution (Chapter 10.24.130 EMC) is, in part, unconstitutionally void for vagueness; and Whereas, the City of Everett has the power to provide for the punishment of all practices dangerous to public health or safety, and to make necessary for the preservation of public health, peace and good order and to provide for the punishment of all persons charged with violating any city ordinances; and Whereas, the Everett City Council deems it appropriate for the crime Permitting Prostitution(Chapter 10.24.130 EMC) to be amended in light of the Everett Municipal Court ruling; NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1. Section 2 of Ordinance No. 1567-89 (EMC 10.24.130), is hereby amended as follows: Permitting prostitution. 1. A person is guilty of permitting prostitution if, having possession or control of premises which he or she knows are being used for prostitution purposes, he or she fails without lawful excuse to make reasonable effort to halt or abate such use. 2. Permitting prostitution is a misdemeanor. Be and the same is hereby amended to read as follows: Permitting prostitution. 1. A person is guilty of permitting prostitution if, having possession or control of premises which he or she knows are being used for prostitution purposes, he or she fails to make reasonable effort to halt or abate such use. 2. Permitting prostitution is a misdemeanor. Section 2. Severability Should any section, subsection, paragraph, sentence, clause or phrase of this Ordinance or its application to any person or situation, be declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portions of this Ordinance or its application to any other person or situation. The City Council of the City of Everett hereby declares that it would have adopted this Ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, clauses, phrases or portions be declared invalid or unconstitutional.
