ORDINANCE No. 3551-17 <br /> AN ORDINANCE Relating to Permitting Prostitution, Amending Section 2 of Ordinance No. 1567-89, as <br /> Amended (Chapter 10.24.130 EMC). <br /> Whereas, the Everett Municipal Court has recently ruled that the City ordinance prohibiting the crime <br /> Permitting Prostitution (Chapter 10.24.130 EMC) is, in part, unconstitutionally void for vagueness; and <br /> Whereas, the City of Everett has the power to provide for the punishment of all practices dangerous to <br /> public health or safety, and to make necessary for the preservation of public health, peace and good order and to <br /> provide for the punishment of all persons charged with violating any city ordinances; and <br /> Whereas, the Everett City Council deems it appropriate for the crime Permitting Prostitution(Chapter <br /> 10.24.130 EMC) to be amended in light of the Everett Municipal Court ruling; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Section 2 of Ordinance No. 1567-89 (EMC 10.24.130), is hereby amended as follows: <br /> Permitting prostitution. <br /> 1. A person is guilty of permitting prostitution if, having possession or control of premises which he or she <br /> knows are being used for prostitution purposes, he or she fails without lawful excuse to make reasonable <br /> effort to halt or abate such use. <br /> 2. Permitting prostitution is a misdemeanor. <br /> Be and the same is hereby amended to read as follows: <br /> Permitting prostitution. <br /> 1. A person is guilty of permitting prostitution if, having possession or control of premises which he or she <br /> knows are being used for prostitution purposes, he or she fails to make reasonable effort to halt or abate <br /> such use. <br /> 2. Permitting prostitution is a misdemeanor. <br /> Section 2. Severability <br /> Should any section, subsection, paragraph, sentence, clause or phrase of this Ordinance or its application to any <br /> person or situation, be declared unconstitutional or invalid for any reason, such decision shall not affect the <br /> validity of the remaining portions of this Ordinance or its application to any other person or situation. The City <br /> Council of the City of Everett hereby declares that it would have adopted this Ordinance and each section, <br /> subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, <br /> subsections, clauses, phrases or portions be declared invalid or unconstitutional. <br />
