T-Mobile Site ID:SE01845A Cascade HS North WI' <br /> Market:PNW <br /> City of Everett Site ID:Olympic Tank <br /> the Site shall not conflict with Lessor's use of the Site and related facilities. Lessee <br /> agrees that its use of the Site shall not conflict with the use of the Site and related <br /> facilities of other users. Lessee shall label all antennas and equipment in a manner <br /> that provides readily visible ownership identification. <br /> f. After receipt of written authorization by the Lessor; and all necessary government <br /> approvals, Lessee is authorized to construct on the Site; and Lessee has the right to <br /> prepare, maintain and alter the Site for Lessee's business operations and to install <br /> transmission lines, connecting antennas to the transmitters and receivers. <br /> g. Lessee agrees that in the event there is any interference with Lessor's transmitters <br /> and/or receivers or in the event there is any interference with the transmitters and/or <br /> receivers of other lessees established at the Site prior to the Effective Date of this <br /> Lease, caused by Lessee's transmitter(s) and/or receiver(s), which is not remedied <br /> by Lessee within seventy-two (72) hours of written notification by Lessor, the <br /> Lessee agrees to cease using the equipment which is creating the interference <br /> (except for short tests necessary for the elimination of the interference) until the <br /> interference is eliminated. Provided, however, notwithstanding any language <br /> herein, Lessee agrees that in the event that Lessee's wireless communications <br /> facility, installation or equipment causes any interference with a public safety <br /> communications system(s) whether said system is existing, planned or yet to be <br /> constructed that is not remedied by Lessee within six(6)hours of verbal notification <br /> by the public safety communications system, Lessee agrees to cease using the <br /> facility or equipment which is creating the interference (except for short tests for <br /> the elimination of the interference when authorized by the public safety <br /> communications system) until the interference is eliminated to a standard and <br /> manner acceptable to the public safety communications system. <br /> 4. RENT: On the first day of each and every calendar month commencing on the first <br /> day of the first calendar month of the Initial Term, Lessee shall pay to the Lessor rent as follows: <br /> i. The Lessee shall pay rent to the Lessor at the monthly rate of Two Thousand and <br /> no/100 DOLLARS ($2,000.00) ("Rental Fee") in U.S. Dollars, or Lessee may choose to pay said <br /> rent in advance on an annual or semi-annual basis. <br /> ii. Said Rental Fee shall increase on May 1st, 2018, and each May 1St of each <br /> subsequent year thereof by an amount equal to four percent (4%) of the Rental Fee in effect for <br /> the previous year. <br /> iii. Such Rental Fee shall be paid as and when due to City of Everett, as designated in <br /> this Lease, or at such other address which the Lessor designates by written notice to Lessee. <br /> iv. The Rental Fee shall not include electricity. Lessee shall have a separate meter to <br /> measure Lessee's electric consumption and Lessee shall pay directly to the public utility company <br /> for any electricity used by Lessee's equipment. <br /> Page 3 of 21 <br />
