• <br /> CITY <br /> • <br /> LICENSE TO USE CITY PROPERTY <br /> THIS LICENSE AGREEMENT(the"License"), between the City of Everett as <br /> Grantor(the"City)and Stripe Rite, Inc., 1813 137th Ave East, Sumner, WA 98390 as <br /> the Grantee("Stripe Rite"), relates to an approximately 1.38 acre portion of property <br /> owned by the City located at 4015 Railway Ave, Everett, WA (the"Property"). <br /> RECITALS <br /> A. Stripe Rite desires to utilize property owned by the City for staging and <br /> placement of construction materials while performing work for the City's 2017 Pavement <br /> Improvement Marking("Project") <br /> B. The City is willing to grant Stripe Rite authority to use the City's <br /> property upon certain terms and conditions. <br /> AGREEMENT <br /> In consideration of mutual benefits and other good and valuable consideration,the receipt <br /> and sufficiency of which is hereby expressly acknowledged,the City licenses Stripe Rite <br /> to use the Property upon the following terms and conditions: <br /> Section 1. LICENSED PROPERTY. The specific area of property owned by the <br /> City, and subject to this License, is an area and is more fully set forth as depicted in <br /> Exhibit A,attached hereto,or as otherwise directed by the City's on-site supervisor(Roy <br /> Harris or Mike Hale). <br /> Section 2. TERM. This License shall be effective beginning May 1,2017,and shall <br /> expire on July 30,2017, unless terminated earlier upon 30-days' notice per Section 7, <br /> below. <br /> Section 3. FEE. Strip Rite shall pay a one-time fee of$550.00 for this license use of <br /> City property. <br /> Section 4. AUTHORIZED USE. Stripe Rite may only use the Property for the <br /> purpose of storing, loading,and unloading materials in conjunction with the Project being <br /> performed for the City. Incident to this authorized use,Stripe Rite may install temporary <br /> fencing in conformance with Section 16, below. <br /> page 1 <br />
