• <br /> Notice to City Notice to Grantor <br /> Real Property Manager Port of Everett <br /> 3200 Cedar St. Properties Group <br /> Everett, WA 98201 1205 Craftsman Way, Suite 107 <br /> Everett, WA 98201 <br /> A party may change its address stated above by delivering written notice to the other <br /> party of the new address. <br /> I. Attorneys' Fees and Costs. The prevailing party in any action brought <br /> to enforce any obligations under this Covenant shall be entitled to recover from the non- <br /> prevailing party or parties an amount equal to the reasonable attorney's fees and costs incurred <br /> by the prevailing party, including without limitation any costs incurred on appeal or in any <br /> bankruptcy proceeding. If the prevailing party has in-house legal staff, the prevailing party is <br /> entitled to compensation for legal staff time. <br /> J. Enforcement. The parties are expressly entitled to equitable remedies to <br /> enforce this Covenant, including without limitation injunctions and specific performance. These <br /> equitable remedies are in addition to any other remedies a party may have under this Covenant or <br /> applicable law. <br /> K. Old Covenant Superseded.
