Section 1. Findings of Fact. The "WHEREAS" provisions above shall <br />constitute findings of fact and are incorporated by reference as if fully set forth <br />herein. <br />Section 2. Interim Regulation Established. An interim regulation <br />concerning the establishment and processing of applications for homeless <br />encampments in the City is hereby established. Establishing such facilities <br />contrary to the provisions of this Ordinance is prohibited during the period of <br />this interim regulation. With the exception of temporary use permits for <br />homeless encampment facilities that are in full compliance with this <br />Ordinance, applications for temporary use permits, land use approvals, or any <br />other permit or approval, in any way associated with such facilities shall not <br />be accepted, processed, issued, granted, or approved during the term of this <br />interim regulation. <br />Section 3. Term. The interim regulation established by this Ordinance shall <br />be effective for six (6) months after passage unless earlier repealed or <br />renewed according to law. <br />Section 4. Standards for Homeless Encampments. <br />The following definitions and standards apply to homeless encampments for <br />the purposes of application for and approval of a temporary use permit: <br />A. Definitions <br />1. Homeless encampment — A group of homeless persons temporarily <br />residing out of doors on a site with services provided by a sponsor and <br />supervised by a managing agency. <br />2. Managing agency — An organization that has the capacity to organize and <br />manage a homeless encampment. A "managing agency" may be the same <br />entity as the sponsor. <br />3. Sponsor — A local church or other local, community-based organization <br />that has an agreement with the managing agency to provide basic services <br />and support for the residents of a homeless encampment and liaison with the <br />surrounding community and joins with the managing agency in an application <br />for a temporary use permit. A "sponsor" may be the same entity as the <br />managing agency. <br />B. Standards <br />1. The encampment shall be located a minimum of 40 feet from the property <br />line of abutting properties containing residential uses; any tent, canopy or <br />membrane structure, as defined in Chapter 24 of the International Fire Code, <br />
