Plan," received on July 15,for the property <br /> located at Hardeson and 75'1'Street. The plan depicts proposed grade changes to the property,as well as <br /> construction entrances and sedimentation pond. Apart from the proposed grading measures,the City has not <br /> received any specific development plans for this property. The SEPA Determination for the rezone and Binding <br /> Site Plan contained a requirement that: <br /> "A SEPA/Planned Action review will be required prior to development of the rezone parcel(Lot <br /> I of the preliminary Binding Site Plan)." (SEPA No. 08-040). <br /> Additionally,Table 1-2 of Ordinance No.2213-97 states that grading activity not associated with a specific <br /> development is not a use or activity analyzed under the SW Everett/Paine Field EIS. Since the City cannot <br /> consider a clearing and grading proposal without first reviewing a development plan for the property,we <br /> cannot approve the grading plan at this time. We note that circumstances for the subject lot are different <br /> from the adjacent parcel to the south because that parcel had a development plan approved through a prior <br /> SEPA review (SEPA No. 06-067). The development plan for Lot 1 was voided by the 2008 rezone. <br /> We also note there are critical area,grading and drainage issues that need to be considered jointly with <br /> proposed development on the abutting lot to the south. These issues will need to be addressed as part of any <br /> subsequent development proposal on Lot 1 of the Binding Site Plan. The City needs to understand how <br /> development on this site relates to development on the abutting parcel to the south, particularly the impacts <br /> to the weland/buffer and required mitigation.
