DHS published the required <br /> recipient guidance in April 2011, DHS Guidance to Federal Financial Assistance <br /> Recipients Regarding Title VI Prohibition Against National Origin Discrimination <br /> Affecting Limited English Proficient Persons, 76 Fed. Reg. 21755-21768, (April 18, <br /> 2011). The Guidance provides helpful information such as how a recipient can <br /> determine the extent of its obligation to provide language services; selecting <br /> language services; and elements of an effective plan on language assistance for <br /> LEP persons. For additional assistance and information regarding language <br /> access obligations, please refer to the DHS Recipient Guidance at <br /> https://www.dhs.gov/guidance-published-help-department-supported- <br /> organizations-provide-meaningful-access-people-limited and additional resources <br /> on http://www.lep.gov. <br /> 8. NIMS COMPLIANCE <br /> a. The National Incident Management System (NIMS) identifies concepts and <br /> principles that answer how to manage emergencies from preparedness to <br /> recovery regardless of their cause, size, location, or complexity. NIMS <br /> provides a consistent, nationwide approach and vocabulary for multiple <br /> agencies or jurisdictions to work together to build, sustain, and deliver the <br /> core capabilities needed to achieve a secure and resilient nation. <br /> b. Consistent implementation of NIMS provides a solid foundation across <br /> jurisdictions and disciplines to ensure effective and integrated <br /> preparedness, planning, and response. NIMS empowers the components <br /> of the National Preparedness System, a requirement of Presidential Policy <br /> Directive (PPD)-8, to guide activities within the public and private sector <br /> and describes the planning, organizational activities, equipping, training <br /> and exercising needed to build and sustain the core capabilities in support <br /> of the National Preparedness Goal. <br /> c. The Subrecipient agrees that in order to receive FFY 2015 federal <br /> preparedness funding, to include HSGP, NIMS compliance requirements <br /> for 2015 must be met. <br /> B. HSGP SPECIFIC REQUIREMENTS <br /> 1. 15HSGP stipulates the following for overall grant funding; specific caps or <br /> thresholds for this Agreement may differ: <br /> a. Up to 5% percent of the HSGP award received by the Department may be <br /> used for management and administrative purposes directly related to <br /> administration of the HSGP grant. The maximum percentage of the Grant <br /> Agreement Amount that may be used by the Subrecipient for management <br /> and administration costs under this Agreement is identified in the Budget <br /> (Exhibit E), and may be less than, but will not exceed, the maximum 5%. <br /> b. At least 25% of the combined HSGP award allocated under SHSP and <br /> UASI are to be dedicated towards law enforcement terrorism prevention <br /> activities (LETPA). The LETPA percentage of the Grant Agreement <br /> Amount that must be met as a minimum requirement of this Agreement by <br /> the Subrecipient is identified in the Budget (Exhibit E) and may differ from <br /> the combined 25% requirement. <br /> c. The combined total of personnel expenses may not exceed 50% percent <br /> of the HSGP award received by the County unless a Personnel Cap Waiver <br /> has been received from DHS. The maximum percentage of the Grant <br /> Agreement Amount that may be used by the Subrecipient for personnel <br /> expenses under this Agreement is identified in the Budget (Exhibit E) and <br /> may differ from the 50% HSGP limit. <br /> DHS-EMD-Sno.Co.-UASI-FFY15 Page 9 of 25 E16-051 -Everett <br />
