ORDER AMENDING HEARING EXAMINER'S DECISION <br /> The Hearing Examiner, having reviewed the pleadings and other <br /> documents on file in this matter, having considered the foregoing Motion to <br /> Amend, and having determined that the City served the Respondents with notice <br /> of this Motion, issues the following order: <br /> 1. Respondent Adam Perry was not issued a Violation Citation in the <br /> above-captioned matter and is hereby dismissed from this matter. <br /> 2. Findings of Fact, Conclusions of Law and Order of the Hearing <br /> Examiner entered on May 20, 2010, in the above-captioned matter (the "Decision") <br /> are amended with the deletion of paragraph 3 of the section title "Order," and <br /> replacing it with -the following: <br /> 3. <br /> "Vu Nguyen and Shannon Hunter-Nguyen shall <br /> abate all violations of EMC §19.41.020 at 1509 <br /> McDougall Avenue, Everett, Washington. Vu <br /> Nguyen and Shannon Hunter-Nguyen shall cause <br /> the unauthorized detached accessory dwelling unit <br /> to be unoccupied by August 15, 2010. This time <br /> period will allow Vu Nguyen and Shannon Hunter <br /> Nguyen to comply with notice requirements to <br /> terminate a tenancy under the Washington State <br /> Landlord Tenant Act." <br /> 4. Failure to comply with the Hearing Examiner's May 20, 2010, <br /> Decision, as amended by this Order will result in further civil or criminal <br /> enforcement actions. <br /> 5. No other Changes to the original order are made. <br /> ORDERED THIS 3`d day of June, 2010. <br />
