I. Findings of Fact: a. Shannon Hunter Nguyen and Vu Nguyen are wife and husband, and own the property at 1509 McDougall Avenue, Everett, Washington. b. The Nguyen's property includes a residential structure and a detached garage and the property is located in an area zoned R-2. c. Prior to the Nguyens' purchase of the property, the garage was converted into residential living space, and was done so without benefit of permit. d. The Nguyens have since modified the garage, adding more interior space to it, and storage on the outside portion of the building. The modifications were done without permit. e. The garage is presently occupied by members of the Nguyens' extended family. f. Presently there is no off-street parking at 1509 McDougall Avenue as required by code. II. Conclusions of Law: a. The City of Everett Violations Hearings Examiner has jurisdiction in this matter pursuant to Everett Municipal Code (hereinafter EMC) 1.20.030(A)(19): "...the enforcement procedure authorized in this chapter shall be the enforcement procedure of the following regulations of the city...Zoning;" and EMC 19.41.30: Enforcement, violation and penalties: "Enforcement of the provisions of title and of any permits or approvals issued pursuant thereto shall be performed in accordance with the procedures established in this title and Chapter 1.20 EMC."
