Pursuant to an Order of the Everett Hearing Examiner, the record was held open until 5:00 p.m. , December 26, 1989, in order that additional exhibits could be submitted for the record. The record was held open partially for the reason that one of the appellants, Terry Slatten, objected to the limited time available for the appellants to respond to the staff report that was given to the Everett Hearing Examiner. Based on the objection that the staff report was given within an hour before the hearing and insufficient time was available to make an argument on the material contained in the staff report, the Everett Hearing Examiner extended the period to submit written evidence until December 26, 1989. On December 26, 1989, the record was officially closed. After due consideration of the evidence presented by the Applicant; evidence elicited during the public hearing; and as the result of the personal inspection of the subject property and surrounding areas by the Everett Hearing Examiner, the following findings of fact and conclusions constitute the basis of the decision of the Everett Hearing Examiner.
