Submittal to Jim Driscoll from Terry Slatten received 12/26/89 <br /> All of these exhibits were reviewed and are the source of the findings. <br /> Pursuant to an Order of the Everett Hearing Examiner, the record was held open <br /> until 5:00 p.m. , December 26, 1989, in order that additional exhibits could be <br /> submitted for the record. The record was held open partially for the reason <br /> that one of the appellants, Terry Slatten, objected to the limited time <br /> available for the appellants to respond to the staff report that was given to <br /> the Everett Hearing Examiner. Based on the objection that the staff report <br /> was given within an hour before the hearing and insufficient time was <br /> available to make an argument on the material contained in the staff report, <br /> the Everett Hearing Examiner extended the period to submit written evidence <br /> until December 26, 1989. On December 26, 1989, the record was officially <br /> closed. <br /> After due consideration of the evidence presented by the Applicant; evidence <br /> elicited during the public hearing; and as the result of the personal <br /> inspection of the subject property and surrounding areas by the Everett <br /> Hearing Examiner, the following findings of fact and conclusions constitute <br /> the basis of the decision of the Everett Hearing Examiner. <br />
