/ 1 <br /> everett <br /> the Evergreen <br /> IN TBE MATTER OF THE APPEAL OF CAROL CITY OF <br /> LIVELY, T A , MARK SULLIVAN, everett <br /> AND JOANNE WILDMAN OFFICE OF THE <br /> LAND USE and VIOLATIONS <br /> ORDER HEARING EXAMINER <br /> On January 12, 1990, the Everett Hearing Examiner reversed the decision of the <br /> Everett Planning Department and granted the appeal of Carol Lively, Terry <br /> Slatten, Mark Sullivan, and Joanne Wildman. The appeal was on the City's <br /> certification of a non-conforming use for property located at 4228 South Third <br /> Avenue, Everett, Washington. <br /> On January 29, 1990, pursuant to the Rules of Procedure for Proceedings before <br /> the Everett Hearing Examiner, and in particular Rule 8.3.C, Craig VanSant, by <br /> and through his attorney, Bradford Cattle, requested reconsideration of the <br /> January 12, 1990, decision. The motion for reconsideration was based on the <br /> contentions that there were factual discrepancies within the Decision and that <br /> the property owner did not have the opportunity to make clarifications at the <br /> hearing and thus did not have due process. <br /> In light of the motion for reconsideration and for the purpose of insuring <br /> that all parties are granted a fair hearing and due process in this <br /> proceeding, the hearing will be reconvened on February 22, 1990, at 3:00 <br /> p.m.in the hearing roam on the third floor of the Wetmore Building located at <br /> 2731 Wetmore Avenue, Everett, Washington. The purpose of the reconvened <br /> hearing will be to determine if any additional facts not presented at the <br /> original hearing on December 19, 19 89, have an implication on the Decision of <br /> this matter. The scope of review will be narrow and limited to the past usage <br /> of the property. <br /> This Order constitutes notice of said hearing and shall be mailed to all <br /> parties of record at least five days prior to the above stated hearing date. <br /> Done and dated this 12th day of February, 1990. <br /> lrw M.
