RESOLUTION NO. 3 A 9 S <br /> WHEREAS, the assessment roll for LID No. 714A of the City <br /> of Everett has been confirmed and presented to the City <br /> Treasurer of the City of Everett for collection; and <br /> WHEREAS, it has been discovered and brought to the <br /> attention of the City Council of the City of Everett and the <br /> City Council finds that the assessment on Parcel 72 (Lot 38 of <br /> Broadway Crest, according to the plat thereof recorded in <br /> Volume 12 of Plats, Page 5 , records of Snohomish County, <br /> Washington) was primarily based on the assumption that the <br /> property received sewer access as a result of the LID <br /> construction project; and <br /> WHEREAS, the construction records for the sewer main <br /> along Meridian Avenue, which was constructed under LID No. <br /> 714A, does not extend at least five feet in front of Parcel <br /> 72 ; and <br /> WHEREAS, a connection to the Meridian Avenue sewer from <br /> Parcel 72 would require a deviation from the connection <br /> standards given in the City's Design and Construction <br /> Standards and Specifications; and <br /> WHEREAS, the City Council of the City of Everett finds <br /> that the aforesaid errors have resulted in an assessment on <br /> Parcel 72 which is irregular and not in conformance with the <br /> ordinance establishing the LID and the basis for assessment <br /> therein, and not equal to assessments on equivalent property <br /> within the boundaries of the LID and, therefore, the <br /> assessment on Parcel 72 should be annulled; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES RESOLVE: <br /> 1 . That a hearing shall be held to annul the assessment <br /> on Parcel 72 (Lot 38 of Broadway Crest, according to the plat <br /> thereof recorded in Volume 12 of Plats, Page 5, records of <br /> Snohomish County, Washington) under LID No. 714A. <br />
