1 ` IN THE MATTER OF '13E APPLICATION OF <br /> PATRICIA AND DAVID MUMM AND TERESA <br /> NELSON FOR APPROVAL OF A SPECIAL <br /> PROPERTY USE PERMIT SPU #73-89 <br /> ORDER <br /> I. AMENDED FINDINGS OF FACTS <br /> On November 2, 1989, approval for a Special Property Use Permit was granted <br /> for an expanded operation of a child day care center on property located at <br /> 6533 Beverly Lane, Everett, Washington. Approval was made subject to <br /> conditions, including condition #3 which stated: <br /> 3. The parents must use the on-street marked parking spaces <br /> on the east side of Beverly Lane between Tamarack and <br /> Beech for drop off and pick up of children. <br /> Subsequent to the issuance of the decision of November 2, 1989, motions for <br /> reconsideration were submitted. A summary of the motions for reconsideration <br /> is as follows: <br /> A. Steven W. Weissenfluh (submitted November 8, 1989) <br /> Mr. Weissenfluh submitted that there was no support in the November 2, <br /> 1989, findings of facts and conclusions of law for the imposition of <br /> condition #3. He stated that the safety of the children should be <br /> considered and that the driveway is the safest way to reach the day care <br /> facility. He recommended that condition #3 be withdrawn. <br /> B. Jacqueline C. Schindler (submitted November 17, 1989) <br /> Ms. Schindler submitted that safety is an important factor at the day <br /> care facility and requested the reconsideration of condition #3. She <br /> claimed that Beverly Lane, a main arterial, carries traffic that moves <br /> at high speeds. The driveway would be a safer place for the children to <br /> exit and enter vehicles. <br /> C. April Bettinger (submitted November 17, 1989) <br /> Ms. Bettinger submitted that she travels in a southerly direction on <br /> Beverly Lane and uses the driveway for access. She submitted that if <br /> she is not able to use the driveway, she will disrupt traffic on Beverly <br /> Lane by first pulling into the driveway and then backing out into the <br /> allotted spaces. She opposed the imposition of condition #3. <br /> D. Patricia Mum (submitted November 16, 1989) <br /> Mrs. Mum submitted that the driveway provides safe access for the day <br /> care facility. <br /> E. Tonia Maus (submitted November 17, 1989) <br /> Ms. Maus opposed condition #3 because it impacted the safety of the <br /> children at the day care facility. She also voiced opposition to <br /> condition #9. <br /> 8 ?, <br />
