with this standard. The City expects customers to be treated with courtesy,
<br /> dignity and respect. Canteen agrees to inform the City's agent, identified in
<br /> Section 8, of any problems with customer service or customer complaints.
<br /> B. Products/Services Vended
<br /> 1. Canteen shall provide coffee services and install vending and other
<br /> related equipment to dispense food, beverage, and sundry products supplied by
<br /> Canteen at the sites and facilities described in Exhibit B (Premises). Canteen will
<br /> install, maintain, and service the equipment in a sanitary manner in accordance
<br /> with industry standards and all federal, state, and local laws. Canteen shall include
<br /> snacks that are healthy in nature. The City reserves the right to review and
<br /> approve healthy snack options as provided by Canteen. Canteen agrees to comply
<br /> with requests by the City to supply certain products, or not to supply certain
<br /> products, provided that any such request shall be reasonable. Canteen shall not
<br /> stock, offer to sell, or sell any alcohol or tobacco product at any time on any City
<br /> property. The City has no right, title, or interest to the equipment or products, and
<br /> shall not assert or disturb rights, title, or interest to any equipment, inventory, or
<br /> other property furnished or installed by Canteen at the Premises. Unless otherwise
<br /> provided herein or unless Canteen fails to remove such equipment, inventory or
<br /> other property within a reasonable amount of time after termination of this
<br /> Agreement, the City shall not operate, remove, or tamper with such the
<br /> equipment, products, or other Canteen property. The City shall only be
<br /> responsible for damage to the equipment caused by the willful or negligent acts or
<br /> omissions of the City, its agents, or employees. In the event that a piece of
<br /> equipment is not generating an appropriate volume of net sales, Canteen may, at
<br /> its sole discretion, remove such piece of the equipment.
<br /> 2. Canteen is permitted to sell souvenirs, counter toys, pictures, and
<br /> other items usually considered novelties. Such novelties, including their
<br /> packaging, shall be appropriate for use, sale, or viewing by young children and
<br /> families and shall not be offensive to reasonable persons. Novelties and
<br /> packaging may not include vulgarities or obscenity or language,pictures, or
<br /> drawings or pictures that would cause affront or offend a reasonable person. Such
<br /> novelties and packaging must not be of such a nature as to constitute an
<br /> unreasonable risk to safety, health or property, or likely interfere with the usual or
<br /> customary activities enjoyed by participants at the City's property. The City's
<br /> decision on such items shall be final and binding.
<br /> 3. The City will furnish Canteen with the necessary space, trash
<br /> removal, extermination services, and utilities to permit the sanitary operation of
<br /> the services. However, Canteen is solely responsible for determining whether it
<br /> can operate its services in a sanitary manner in accordance with industry standards
<br /> and all federal, state, and local laws. If Canteen determines that it cannot so
<br /> operate in a sanitary manner, then Canteen may, as its sole remedy, terminate this
