Zai <br /> A RESOLUTION of the City Council of the City of Everett, <br /> Washington, declaring its intention to order the installation of a <br /> sanitary sewer system along 7th Avenue S.E. and intersecting side <br /> streets within the City and to create a local improvement district <br /> to assess the cost and expense of carrying out such improvements <br /> against the properties specially benefited thereby; and notifying <br /> all persons who desire to object to the improvements to appear and <br /> present their objections at a hearing before the City Council to <br /> be held on September 13, 1989. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVERETT, WASHINGTON, <br /> as follows: <br /> Section 1: It is the intention of the City Council of the City of <br /> Everett, Washington (the "City") to order the improvement of the properties <br /> within the area described in Exhibit A, attached hereto and by this reference <br /> made a part hereof, by the construction and installation of a sanitary sewer <br /> system described in Exhibit B, attached hereto and by this reference made a <br /> part hereof. <br /> All of the foregoing improvements shall be in accordance with the plans <br /> and specifications therefor prepared by the City Engineer and may be modified <br /> by the City as long as such modification does not affect the purpose of the <br /> improvement. <br /> Section 2: The total estimated cost and expense of the improvements is <br /> declared to be $977,200, approximately 60 percent of which cost and expense <br /> shall be borne by and assessed against the property specially benefited by <br /> such improvements to be included in a local improvement district to be <br /> established embracing as nearly as practicable all the property specially <br /> benefited by the improvements. The balance of such cost and expense shall be <br /> paid by the City pursuant to Ordinance No. 1561-89 and reimbursed from future <br /> monthly utility service surcharges within the local improvement district. <br /> Actual assessments may vary from assessment estimates so long as they do not <br /> exceed a figure equal to the increased true and fair value the improvements <br /> add to the property. <br />
