L2 og <br /> A Resolution Denying an Appeal of <br /> Boundary Line Adjustment #21-88 and Affirming <br /> The City of Everett Hearing Examiner's Decision <br /> WHEREAS, on September 2, 1988, John Robinett, 1001 Broadway #A10, <br /> Everett, Washington submitted a Boundary Line Adjustment in accordance with <br /> the City of Everett Boundary Line Adjustment Ordinance; and <br /> WHEREAS, the City of Everett Planning Department reviewed said <br /> application #21-88 and found it to be consistent with the City of Everett <br /> Boundary Line Adjustment Ordinance and granted Preliminary approval on <br /> October 28, 1989; and <br /> WHEREAS, adjacent property owners filed an appeal of the City of <br /> 1 <br /> Everett Planning Department decision to Grant Preliminary Approval of <br /> Boundary Line Adjustment #21-88 on February 10, 1989; and <br /> WHEREAS, the City of Everett Hearing Examiner held an appeal hearing <br /> (!� on April 6, 1989. At this hearing testimony was presented for and against <br /> granting the Approval of Boundary Line Adjustment #21-88; and <br /> WHEREAS, On April 28, 1989 the City of Everett Hearing Examiner <br /> rendered his decision that he had no jurisdictional authority to hear the <br /> appeal because the time for filing an appeal on the boundary line adjustment <br /> preliminary approval had lapsed; and <br /> WHEREAS, on June 12, 1989 appellants Ratliff and Kellerman filed an <br /> appeal to the Everett City Council; and <br /> WHEREAS, the City of Everett Planning Department furnished the <br /> Everett City Council with a complete record of the matter before the Hearing <br /> Examiner; and <br /> { i <br />
