000006 HEARING EXAMINER DECISION <br /> RE: AP-#2-89 4/27/89 <br /> Page 7 <br /> approximately 111 feet. Lot 1 was 20 feet wide, while the other <br /> three lots were 25 feet in width. The lot line adjustment re- <br /> quested by the Applicant changed the east/west configuration to a <br /> north/south configuration. The new lots are identified as lots A <br /> and B. The west boudnary of lot B is Tulalip Avenue, and the east <br /> boundary is approximately 53 .25 feet east of the west boundary. <br /> The east boundary of lot B would be the west boundary of lot A. <br /> The width of new lot A would be 57 . 75 feet. <br /> 23. A non-conforming duplex exists on lots 1 , 2 and 3 of the old <br /> plat. In addition, there is a carport on lot 3 and all of lot 4 <br /> of the old plat. With the lot line adjustment, the existing <br /> duplex and carport will be located in lot A, but it is the intent <br /> of the Applicant to remove the carport, leaving the duplex on lot <br /> A. It is also the Applicant' s intent to develop lot B. <br /> 24. Lots A and B have non-conforming status pursuant to the <br /> authority as set forth in the Hearing Examiner decision of June 3 , <br /> 1988. Although this decision was superceded by City Council <br /> Ordinance approving mergers, the application for the boundary line <br /> adjustment was filed prior to the adoption of the ordinance. <br /> 25. The original plat had four lots. There are only two lots <br /> with the plat as created by the boundary line adjustment. No <br /> additional lots have been created. <br /> 26. The four lots of the old plat were created prior to December <br /> 1 , 1966 , the date of the establishment of zoning within the City <br /> of Everett. <br /> 27. The four lots of the old plat were contiguous and under one <br /> ownership. <br /> 28. New lots created in an R-1 zone must have 7 ,000 square feet <br /> in area and have a 60 foot width. As a result of the boundary <br /> line adjustment, the lots will not satisfy these standards. Lot A <br /> will have a 5 ,486 .25 square foot area, and lot B will have a <br /> 5 ,058 . 75 square foot area. The lot width of lot A will be 57. 75 <br /> feet and the width of lot B will be 53 .25 . <br /> 29 . Because of the existing structure on lot A, the front yard <br /> setback of that property will be 13 feet. <br /> 30. The Appellants submitted that only if all the requirements of <br /> an R-1 zoned lot can be satisfied should the two lots resulting <br /> from the boundary line adjustment be developed. <br /> 000046 <br />
