The witness submitted that the traffic situation on S.R. 527 is becoming <br /> problematic and decisions to add more traffic require careful <br /> consideration. She submitted that mitigation measures for this <br /> development are inadequate and recommended that the right-of-way for <br /> this highway be 100 feet. <br /> The traffic issues were addressed in the limited Environmental Impact <br /> Statement prepared for this project. The facts and figures and <br /> mitigation measures as set forth in the E.I.S. are not before the <br /> Hearing Examiner. The facts and figures are presumed to be correct. <br /> Any relief from the mitigation measures of the E.I.S. must be done <br /> through the administrative procedure provided in the State Environmental <br /> Policy Act. <br /> a- ... <br /> V. David Battle <br /> 1. The petitioner submitted a concurrence with the issues as set forth in <br /> the reconsideration request of the Silver Lake Action Committee. The <br /> petitioner also submitted that the site plan, as proposed by the <br /> Applicant, did not have adequate design, planning or documentation for <br /> the wet pond system within the site and its ability to retain large <br /> volumes of water. He submitted that with 54% of the area being an <br /> impervious surface, significant water will be retained during heavy rain <br /> storms. He contended that at least a one-half acre pond of at least two <br /> feet deep with grasslined swales for filtration purposes is required. <br /> Condition #17 addresses the treatment of storm water run-off on the <br /> site. This requirement mandates that wet ponds throughout the site be <br /> designed to provide for a minimum of 24 hours' detention for all storms <br /> up to, and including, a five year, 24 hour storm. This condition was <br /> submitted by the City of Everett's Planning Department after <br /> consultation with the Engineering Department and Public Works Department <br /> of the City of Everett. It is presumed that the City has adequately <br /> reviewed the potential flooding problems on-site and that this condition <br /> will adequately handle storm drainage. <br /> 2. The petitioner requested that a covenant be required prohibiting the <br /> development from having access via 23rd Drive S.E. No access is <br /> proposed to this site via 23rd Drive S.E. Any access through this <br /> street will be required to be reviewed by the City. Based on the <br /> presentation of the Planning Department, this access to the multi-family <br /> development through a single family residential street is highly <br /> unlikely. If access is, in fact, granted, the decision can be appealed <br /> through the administrative process of the City of Everett. <br /> 000043 <br />
