1 RESOLUTION NO. ce/4/ <br /> 2 A RESOLUTION establishing guidelines for fencing of detention <br /> facilities. <br /> 3 <br /> 4 WHEREAS, the City Council finds that the City requires developers to <br /> 5 provide on-site detention facilities to control stormwater runoff; and <br /> 6 WHEREAS, the City Council finds that the City has constructed regional <br /> 7 detention facilities to control stormwater runoff on an area wide basis and <br /> 8 will continue to construct such facilities ; and <br /> 9 WHEREAS, the City Council finds that pursuant to the Silver Lake Water <br /> 10 Quality Study which was adopted by Council on October 26, 1988, that an <br /> 11 emphasis be placed on controlling the quality of stormwater runoff in <br /> 12 addition to quantity which means that for water quality control there must <br /> 13 be a permanent depth maintained in detention facilities; and <br /> 14 WHEREAS, the City Council finds that the City' s current policy which <br /> 15 requires fencing six (6) feet in height around the perimeter of detention <br /> 16 facilities is not always necessary and may result in restricting the use and <br /> 17 the esthetic value of the detention facility; and <br /> 18 WHEREAS, the City Council finds that it is in the best interest of the <br /> 19 citizens of Everett to promulgate guidelines for determining when it is <br /> 20 appropriate to require fencing of detention facilities ; <br /> 21 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EVERETT DOES HEREBY <br /> 22 RESOLVE that fencing which is six (6) feet in height around the perimeter of <br /> 23 on-site and regional detention facilities is required unless the following <br /> 24 conditions are met: <br /> 25 <br /> 26 1 . The detention facility is designed and constructed with a <br /> ten (10) foot wide safety bench for every three (3) feet of <br /> 27 depth and the slopes are no greater than three (3) <br /> horizontal to one (1 ) vertical ; or <br /> 28 2. The detention facility is designed and constructed so that <br /> 29 the maximum water depth of the facility does not exceed <br /> three (3) feet during a twenty-five (25) year storm nor <br /> 30 exceed three (3) feet during a twenty-four (24) hour storm <br /> for a maximum of four (4) hours; the maximum side slope of <br /> 31 the facility does not exceed three (3) horizontal to one <br /> (1 ) vertical ; and the detention facility is a dual use <br /> 32 facility; or <br />
