The Hearing Examiner did consider all relevant issues pertaining to <br /> the proposed Subdivision Alteration and Variance. <br /> 4. The Hearing Examiner did correctly interpret the City of Everett <br /> Zoning Code, the City's Subdivision Ordinance, and RCW 58.17.215. <br /> 5. The Hearing Examiner correctly interpreted all matters of law and <br /> fact pertaining to Subdivision Alteration #1-88 and Variance. <br /> 6. The Everett City Council in a public meeting did properly consider <br /> the Appeal of Marc Y. J. Bhend. <br /> 7. After having reviewed the record and receiving comments and arguments <br /> concerning the Appeal, the City Council finds that an erroneous <br /> procedure, or a substantial error in fact or error in law does not <br /> exist. <br /> THEREFORE, BE IT RESOLVED THAT the City Council of the City of <br /> Everett denies the Appeal of Marc Y. J.
