1 RESOLUTION NO. .3/c,? <br /> 2 A RESOLUTION opposing the provisions of SB 5415/HB 1461 which <br /> 3 penalize municipal courts. <br /> 4 <br /> 5 WHEREAS, the City Council of the City of Everett finds that the <br /> Municipal Court of the City of Everett has reduced police overtime, reduced <br /> 6 the City' s court costs, and provided greater community accessibility to its <br /> 7 court; and <br /> 8 WHEREAS, SB 5415/HB 1461 discourages and penalizes municipal courts <br /> particularly with respect to payment of fines and forfeitures to the State <br /> 9 <br /> which are proposed to be higher for municipal courts than district courts; <br /> 10 and <br /> 11 WHEREAS, the City Council of the City of Everett finds that the <br /> Municipal Court of Everett has maintained a high level of professionalism <br /> 12 <br /> and fairness and has been able to save the City of Everett a considerable <br /> 13 sum of money over what would have been the cost of contracting with the <br /> 14 Everett District Court, and, accordingly, the City does not concur with the <br /> provisions of SB 5415/HB 1461 that penalize municipal courts; <br /> 15 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br /> 16 EVERETT that: <br /> 17 1 . SB 5415/HB 1461 should not penalize cities for maintaining their <br /> own independent municipal courts. A municipal court can be responsive to <br /> 18 <br /> the needs of its citizenry, economical , and still maintain a high level of <br /> 19 professionalism and fairness. Accordingly, municipal courts should be <br /> 20 encouraged and should pay the same percentage of fines and forfeitures to <br /> the State as district courts. <br /> 21 <br /> 2.
