RESOLUTION NO. --=% uc <br /> A RESOLUTION denying the appeals to the Hearing <br /> Examiner decision approving a Special Property <br /> Use Permit 13-88 and Variance #3-88 for <br /> construction by General Hospital Medical Center <br /> of a medical office building and parking garage. <br /> WHEREAS, on February 12 , 1988 , the City of Everett received <br /> an application from General Hospital Medical Center for a <br /> Special Property Use Permit and Variance to construct a medical <br /> office building and parking garage on their property located on <br /> the west side of Rockefeller Avenue, between 13th and 14th <br /> Streets, and <br /> WHEREAS, on April 7 and April 11 , 1988 the City of Everett <br /> Land Use Hearing Examiner did hold a public hearing on the <br /> proposed Special Property Use Permit and Variance, and did on <br /> April 27 , 1988 issue a decision approving Special Property Use <br /> Permit No. 3-88 and Variance No. 3-88, and <br /> WHEREAS, on or before May 11, 1988 , requests for <br /> reconsideration of the Hearing Examiner's decision were <br /> submitted by Jack E. Pinette, Pauline Kerney, and William Odell , <br /> and on May 18, 1988 the Hearing Examiner did issue an order <br /> denying all the requests for reconsideration, and <br /> WHEREAS, on or before June 2, 1988 , the City Clerk did <br /> receive appeals to City Council on this matter from Jack E. <br /> Pinette, Pauline Kerney, and William Odell , and <br /> WHEREAS, on June 9, 1988, the Hearing Examiner did make <br /> available to the City Council all Exhibits submitted to his <br /> office by all parties of record, and copies of tapes of the <br /> public hearing held on April 7 and 11 , 1988 , and <br /> WHEREAS, on June 15 , 1988, upon due notification to all <br /> parties of record, and at a regular meeting of the Everett City <br /> Council and having reviewed the record herein, the City Council <br /> did consider the appeals to the Hearing Examiner's decision on <br /> Special Property Use Permit #3-88 and Variance #3-88 of Jack E. <br /> Pinette, Pauline Kerney, and William Odell . <br /> NOW, THE EVERETP CITY COUNCIL MAKES THE FOLLOWING FINDINGS: <br /> 1 . The City of Everett Land Use Hearing Examiner did <br /> conduct a legal public hearing in the matter of Special <br /> Property Use Permit No. 3-88 and Variance No. 3-88 on <br /> April 7 and 11 , 1988 . <br /> 2 . The Hearing Examiner did issue a decision in conformance <br /> with the requirements of Ordinance 692-80 as amended and <br /> did properly review all requests for reconsideration. <br /> 3 . The Hearing Examiner did consider all relevant issues <br /> pertaining to the proposed Special Property Use Permit <br /> and Variance. <br /> 4 . The Hearing Examiner correctly interpreted the City of <br /> Everett Comprehensive General Plan and Zoning Code , <br /> Title 19 of the Everett Municipal Code. <br /> 6 <br /> II i <br />
