Conclusion: Since access is not feasible on base, alternative <br /> measures must be taken to mitigate for loss of public access that <br /> will be lost. The Shoreline Master Program encourages exploring <br /> alternative means to provide public access and recreation on the <br /> shoreline and water and deals with the need for providing physical <br /> and visual shoreline access to the general public. Public water <br /> access and water front recreational activities have been severely <br /> restricted due to the industrial nature of Everett's early waterfront <br /> development. The challenge now is to increase the availability of <br /> public access to the salt water area. <br /> J. Finding: BREAKWATER <br /> Breakwater shall meet or exceed all design requirements of the State <br /> Department of Fisheries. <br /> Conclusion: U.S. Fish and Wildlife and Washington Department of <br /> Fisheries have been consulted by the Navy in the design of the <br /> breakwater. A break or gap in the breakwater will lead fish along <br /> the same migration route through the East Waterway that is currently <br /> being used. <br /> K. Finding: DREDGE SPOILS DISPOSAL - <br /> CONDITIONAL USE PERMIT <br /> The use regulations section of the City's Master Program contains the <br /> following provision: "Shoreline uses and activities not specifically <br /> identified, and for which policies and regulations have not been <br /> developed, will be evaluated as a conditional use activity." <br /> Dredge spoils disposal is a conditional use in the <br /> Conservancy-Recreation Environment if it is being utilized in a beach <br /> enrichment project with the minimal impact on water quality. <br /> Confined deep water disposal was not anticipated when the City of <br /> Everett's Shoreline Master Program was developed. Conditional use <br /> permits are granted only after the following points have been <br /> demonstrated: <br /> 1 . The proposed use will not be contrary to the general intent <br /> of Everett's Master Program. <br /> 2. The proposed use will not interfere with the normal public <br /> use of public shorelines. <br /> 3. The proposed use of the site and design of the project will <br /> be compatible with other permitted uses in the area. <br /> 4. The proposed use will cause no significant adverse effects <br /> to the shoreline environment in which it is to be located. <br /> 5. The public interest suffers no substantial detrimental <br /> effect. <br /> Conclusion: The City of Everett Shoreline Master Program contains <br /> the following provisions regarding conditional uses: "A conditional <br /> use permit is used to provide more control and and flexibility in <br /> implementation of the master program regulations. With measures to <br /> control undesirable effects, the range of uses within each of the six <br /> environments can be expanded to include many uses." The intent of <br /> the conditional use section of the master program is to provide a <br /> mechanism to allow the review of uses not classified or not <br /> specifically contemplated in the Master Program. <br /> Precedence for using deep water disposal as an approved method for <br /> dredge spoils disposal has been established. A conditional use <br /> permit was granted for the Washington Department of Natural Resources <br /> (DNR) Port Gardner Disposal Site. It was originally applied for in <br /> 1972 and granted; it has since been reissued in 1978 and 1984. <br /> -7- <br />
