1 RESOLUTION NO. , 7 474a <br /> 2 A RESOLUTION appointing a Moderator to conduct hearings before the <br /> Planning Commission and City Council on the Shoreline Substantial <br /> 3 Development Permit Application regarding the Navy Homeport. <br /> 4 <br /> 5 WHEREAS, the City of Everett has received an application from the U.S. Navy <br /> 6 for a Shoreline Substantial Development Permit regarding the Navy Homeport; and <br /> 7 WHEREAS, the Navy application involves a large volume of information and the <br /> 8 City Council anticipates that complex data and information will be required to be <br /> 9 reviewed and analyzed; and <br /> 10 WHEREAS, the City Council also anticipates that the project applicant and the <br /> 11 public-at-large will present a number of divergent opinions and data and information as <br /> 12 well as diverse legal opinions concerning said application; and <br /> 13 WHEREAS, the City Council desires that all aspects of the procedure be both <br /> 14 fair in substance and appearance recognizing differing points of view and finds that an <br /> 15 impartial Moderator for the public hearings and meetings will assist in determining <br /> 16 legal and procedural issues and aide in eliciting all points of view while assuring that <br /> 17 the permit application proceeds prudently but expeditiously; <br /> 18 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> 19 OF EVERETT that a Moderator shall be appointed to chair and conduct all public <br /> 20 hearings and meetings of the Planning Commission and City Council concerning the <br /> 21 application by the U.S. Navy for a Shoreline Substantial Development Permit regarding <br /> 22 the Navy Homeport. The Moderator shall be legally trained and experienced and shall <br /> 23 be selected jointly by the Chairman of the Planning Commission and the President of <br /> 24 the City Council. The Moderator shall assure that the hearings and meetings follow <br /> 25 appropriate procedures and shall make recommendations to the Planning Commission <br /> 26 and Council on issues of law as may arise during the proceedings. The Moderator shall <br /> 27 be charged with the duty of expediting the hearings and meetings. Repetitive and <br /> 28 non-relevant testimony shall be discouraged, and written testimony shall be <br /> 29 encouraged, particularly scientific, technical or statistical data. In order to expedite <br /> 30 the hearings and meetings and allow all members of the public to be heard, all oral <br /> 31 testimony of the general public should be no more than five (5) minutes, except where <br /> 32 the Moderator rules that a person giving oral testimony is a bona fide group <br />
