CITY OF EVERETT, WASHINGTON RESOLUTION NO. A RESOLUTION of the City Council of the City of Everett, Washington, declaring its intention to order the improvements in the vicinity of 60th Street S.W. and Hardeson Road and creating a local improvement district to assess the cost and expense of carrying out such improvement against the properties specially benefited thereby, and setting a date of hearing on the formation. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVERETT, WASHINGTON, as follows: Section 1. RCW 35.43.040 provides that the legislative authority of a city may order a local improvement district. Section 2. It is the intention of the City Council of the City of Everett, Washington (the "City") , based on RCW 35.43.040, to order the improvement of the properties within the area described in Exhibit A, attached hereto and by this reference made a part hereof, by the construction of those arterial street improvements, standard water system improvements, and standard sanitary sewer improvements described in Exhibit B, attached hereto and by this reference made a part hereof. All of the foregoing improvements shall be in accordance with the plans and specifications therefor prepared by the City Engineer and may be modified by the City as long as such modification does not affect the purpose of the improvement. Section 3. The total estimated cost and expense of the improvements are declared to be $7,300,000. The entire cost and expense of such improvements shall be borne by and assessed against the property specially benefited by such improvements, except any public contributions determined by City Council, if any, that may become available to help defray the cost of such improvements may be added. Such property shall be included in a local improvement district to be established embracing as nearly as practicable all the property specially benefited by the improvement.
