Planning and Community Development Depavintent <br /> October 9,2014 <br /> Everett Renewal, LLC <br /> 375 Kirkland Ave Unit 340 <br /> Kirkland, WA 98033 <br /> RE: 1513 Walnut Street Everett, WA <br /> Parcel ID: 004673 00201100 <br /> Dear Everett Renewal,LLC; <br /> In review of the Nonconforming Building Application submitted to the Planning Department on <br /> September 4,2014, it was determined that a triplex at the above mentioned property is not recognized <br /> as a legal nonconforming use. The property is zoned R-3, Multiple Family Medium Density. In the R- <br /> 3 zone, a maximum of one unit for every 1,500 square feet of lot area is allowed. The density was <br /> established in 1956. This property is on a lot of 3,000 square feet, therefore the maximum density is <br /> two units. <br /> In review of historic records, it was determined that a triplex is not a legal use because it was not <br /> established prior to 1956 and could not be certified as nonconforming, nor was a permit approved for <br /> a change of legal nonconforming use. The use of the structure appears to have been a retail store from <br /> 1900 to around 1980. We first see evidence of a change in the use of the structure to a duplex from <br /> Snohomish County records and then later a triplex from electrical permit records. <br /> Per Section 38.030.13, any use which is nonconforming and has ceased for a period of two or more <br /> years shall lose such nonconforming status. All subsequent use of the property or building shall be a <br /> use which conforms with the requirements of the zoning code. <br /> The Building Division has also reviewed the historical records and recognizes the legal use of the <br /> structure as a duplex. <br /> The Applicant may appeal the Planning Director's decision within fourteen days of the date of this <br /> letter. Appeal forms are available from the Planning Department and must be submitted along with <br /> the required filing fee.
